Q: I’ve heard that sick notes will soon not exist, is this right?

A: From 6th April 2010, doctors will no longer certify an employees absence from work with a sick note but will instead produce a ‘Statement of fitness to work’.
This statement will indicate that either an employee is not fit to work or that they may be fit to work if certain changes are made in the work place. These changes can include a phased return to work, amended duties, altered hours or some workplace adaptations.

Where changes cannot be made the statement should be treated as though the employee is not fit for work. Further guidance for employers can be found on the DWP and BusinessLink websites.

Q: When are the maternity rights for men changing?

A: There will be more maternity rights for fathers of children born after 3rd April 2011. Changes to maternity leave regulations, being implemented from 6th April, means that fathers of these children can take of advantage of a maternity leave ‘swap’.

This will allow the mother to return to work and for the father of the child to continue the maternity leave for up to six months in the last six month period of the leave. In doing this fathers will be entitled to the current statutory maternity pay.
